Server Abuse

Any attempt to undermine or cause harm to a server, or customer, of Premium-Host.com is strictly prohibited.

Unauthorized use of other people's accounts or computers is strictly prohibited. Premium-Host.com will react appropriately to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "Internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning, etc...

Any unauthorized use of accounts or computers by a Premium-Host.com customer, whether or not the attacked account or computer belongs to Premium-Host.com, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.

Abuse of Traffic

The intention of Premium-Host.com is to provide a large space to serve web documents, not an offsite storage area for electronic files. At least 90% of your web pages must be linked with files (.GIF, .JPEG, etc.) stored on Premium-Host.com's server. Web sites found to contain either no html documents or a large number of unlinked files are subject to warning, suspension or cancellation at the discretion of Premium-Host.com management. Any customer who violates Premium-Host.com's policies in abusing either space/site transfer will be notified and given two (2) days to remedy the problem. If the problem is not resolved within the allotted two (2) day period, the client will be billed for the overages, or the account will be deactivated at Premium-Host.com's discretion. Data transfer costs of $5.00/1GB/month will be billed to your account for any usage over your allowed limit.

Unsolicited Commercial Email (Spam)

Unsolicited commercial advertisements are not allowed in e-mail and will likely result in account suspension or cancellation. Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists and as such inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such. Sending a message, especially an advertisement, to more than five recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium. No refunds will be given if your account is terminated for Spam. Server clean up fees may be inccurred if client activities due to spam cause excessive time and labor involved resolving problems relating to spamming activities.

Premium-Host.com reserves the right to deactivate the Client's web hosting account(s) upon any indication of such activity without notice. Client hereby agrees to indemnify and hold harmless Premium-Host.com from any claim resulting from the client's, or any other party's, use of electronic mail service(s) on the client's web hosting account(s).

Premium-Host.com reserves the right to charge a $50 reactivation fee, if client's violation of Premium-Host.com's anti-spamming policy leads to an account deactivation or suspension.

Premium-Host.com will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms

We do not allow clients to install their own chat rooms without prior approval from Premium-Host.com Management. Most chat rooms tend to be large system resource consumers. Because of this, we cannot allow them as an account option. Please Note: Parachat chat rooms do not apply to this rule. They are third party, Java-based chat rooms which are perfectly fine to install.

Abuse of SMTP Mail Server

We do not allow clients to send more than 2,000 pieces of e-mail per day. If you do send more than 2,000 pieces of e-mail per day, your account will be placed on hold for Network Abuse. If you are sending legitimate e-mails and they total more than 2,000 per day, your account will be moved to a special server that is specifically designed to handle high volumes of e-mail. You will be charged $50.00/month in addition to your regular hosting charges if your account is moved to this server. Please contact SMTP@Premium-Host.com to have your domain moved.

Background Running Programs

We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed. For more information please contact Webmaster@Premium-Host.com with your specific needs.

IRC

We currently do not allow IRC or IRC bots to be operated on our servers.

Payment Policies

All accounts are set up on a pre-paid basis. All pricing is guaranteed for the term of pre-payment. Premium-Host.com reserves the right to change prices at any time, unless other terms have been agreed upon.

Any account not brought current within a week (7 days) of e-mail notice is subject to suspension. The customer is responsible for all money owed on the account from the time it was established to the time the customer notifies Premium-Host.com in writing for a request for termination of services. Purchase of domain names are non-refundable. All payments are in U.S. currency.

Cancellations & Money Back Guarantee

Premium-Host.com reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Premium-Host.com if Premium-Host.com institutes its right of cancellation. Any violation of policies that results in extra costs will be billed to the customer (i.e. transfer, space, etc...)

All of Premium-Host.com's web hosting plans are backed by a 30 day money back guarantee. If you are not completely satisfied with our services or support within the first 30 days of your contract, you will be given a full refund of the contract amount. 

This policy does not apply to any additional services such as overages, additional disk space, additional pop accounts, etc. Due to security concerns, all account cancellations must be done in writing by sending an e-mail to accounts@Premium-Host.com.

Refunds will only be processed to the credit card used to purchase services. All refunds will be processed within 15 days of receipt of written cancellation notice.

Lawful Purpose

Premium-Host.com reserves the right to refuse service to anyone. Customers may only use Premium-Host.com server for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. The designation of any materials as such described above is left entirely to the discretion of Premium-Host.com management.

ABUSIVE AND UNETHICAL MATERIALS AND USES INCLUDE, BUT ARE NOT LIMITED TO PORNOGRAPHY, OBSCENITY, NUDITY, VIOLATIONS OF PRIVACY, RACISM, COMPUTER VIRUSES, HACKING, WAREZ AND ANY HARASSING AND HARMFUL MATERIALS OR USES. CLIENT HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS THE PROVIDER FROM ANY CLAIM RESULTING FROM YOUR PUBLICATION OF MATERIALS OR YOUR USE OF THOSE MATERIALS. PROVIDER MAY OR MAY NOT GIVE NOTICE BEFORE DEACTIVATING THE USE OF AN ACCOUNT(S) WHICH THE PROVIDER DECIDES IS AN ABUSIVE OR UNETHICAL USE OF THE VIRTUAL SERVER ACCOUNT(S) OR HOST SERVER(S). PROVIDER MAY CHARGE A $50 DEACTIVATION FEE IF CLIENTS VIOLATION LEADS TO AN ACCOUNT DEACTIVATION OR SUSPENSION.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold Premium-Host.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Premium-Host.com, its agents, customers, officers and employees, which may arise or result from any service provided, performed, agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Premium-Host.com against liabilities arising out of; any injury to person or property caused by any products sold or otherwise distributed in connection with Premium-Host.com's server; any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; copyright infringement; and any defective products sold to customer from Premium-Host.com's server.

In the event it is necessary to refer any dispute to an attorney, collection agency, or a court of law, the prevailing party will be entitled to an award of reasonable attorney's fees, collection fees, and all costs associated with any legal action, whether or not a suit shall actually be filed. Place where the contract is signed and fulfilled shall be Ontario, Canada.

Premium-Host.com will not be responsible for any damages your business may suffer. Premium-Host.com makes no warranties of any kind, expressed or implied, for services provided. Premium-Host.com disclaims any warranty, merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Premium-Host.com and its employees. Premium-Host.com reserves the right to revise its policies at any time.

THIS NO WARRANTY DISCLAIMER EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY PREMIUM-HOST.COM BEYOND THE FEES PAID BY CLIENT FOR SERVICES.

While Premium-Host.com shall make every reasonable effort to protect and backup data for Clients on a regular basis, Premium-Host.com is not responsible for Client's files residing on our servers. Clients are solely responsible for independent backup of data stored on Premium-Host.com server and network.

Due to the public nature of the Internet, all information should be considered publicly accessible. Important or private information should be treated carefully. Provider is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that customers may utilize.

Failure to follow any term or condition will be grounds for immediate account deactivation.
